الملخص
تناولت هذه الدراسة الحماية الجنائية للاستثمار الأجنبي في المملكة العربية السعودية في ضوء رؤية 2030، في إطار السعي إلى توفير بيئة استثمارية آمنة تكفل حماية أموال المستثمر وحقوقه ومعلوماته من صور الاعتداء الإجرامي. وتمثلت مشكلة الدراسة في مدى فاعلية النصوص الجنائية المتفرقة في توفير حماية جنائية متكاملة للاستثمار الأجنبي، وهدفت إلى تحديد نطاق هذه الحماية، وبيان أبرز صور الاعتداء الجنائي، وتحليل مدى تكامل النصوص والجزاءات وفاعلية إنفاذها. واعتمدت الدراسة المنهج الاستقرائي التحليلي والنقدي، مع الاستفادة من المنهج المقارن في نطاق محدود. وتوصلت الدراسة إلى أن الحماية الجنائية للاستثمار الأجنبي في النظام السعودي تتوزع بين أنظمة متعددة بحسب محل الاعتداء والمصلحة المحمية، دون وجود فراغ تجريمي يستدعي إصدار نظام مستقل، إلا أن تفرق النصوص وتباين ضوابط مسؤولية الأشخاص الاعتبارية يستلزمان تعزيز التكامل والوضوح النظامي، كما تبين أن فاعلية الحماية ترتبط بكفاءة الإنفاذ وجمع الأدلة وتعقب المتحصلات الإجرامية واستردادها. وأوصت الدراسة بتطوير قواعد مسؤولية الأشخاص الاعتبارية ومعايير الجزاءات، وتعزيز التنسيق بين الجهات المختصة وبرامج الامتثال، ووضع ضوابط للتمييز بين الجرائم والإخلالات العقدية، وتطوير آليات استرداد الأموال والتعاون القضائي الدولي.

Abstract
This study examines the criminal protection of foreign investment in the Kingdom of Saudi Arabia in light of Saudi Vision 2030, within the broader objective of fostering a secure investment environment that safeguards investors’ assets, rights, and information against various forms of criminal conduct. The study addresses the effectiveness of the dispersed criminal and economic provisions within Saudi laws in providing integrated criminal protection for foreign investment. It aims to define the scope of such protection, identify the principal forms of criminal conduct affecting foreign investment, and assess the integration of the relevant legal provisions, sanctions, and enforcement mechanisms. The study adopts inductive, analytical, and critical approaches, with limited use of the comparative method. The study finds that criminal protection of foreign investment under Saudi law is distributed across multiple laws according to the subject matter of the offense and the legally protected interest. While there is no comprehensive legislative gap requiring the enactment of a separate law governing investment-related crimes, the fragmentation of relevant provisions and the varying standards of corporate criminal liability call for greater legal coherence and clarity. The study further finds that effective protection depends on efficient enforcement, evidence collection, and the tracing and recovery of criminal proceeds. It recommends developing the rules governing corporate criminal liability and sanctioning criteria, strengthening coordination among competent authorities and compliance programs, establishing clearer standards for distinguishing criminal conduct from contractual breaches, and enhancing mechanisms for asset recovery and international judicial cooperation.
