الملخص

ملخص: تعليل القرارات الإدارية أفضل الوسائل التي تسهل مراقبة المواطنين والقضاء الإداري لمشروعية الأعمال الإدارية باعتباره يدعم مبدأ شفافية العمل الإداري ويجعل السلطة الإدارية بمفهومها الشامل تتقيد بمبدأ المشروعية في تصرفاتها اتجاه الغير، 3757 كما من شأنه الحد من البيروقراطية ومن غلو السلطة التقديرية للإدارة 3758 ثم يعد دعامة إضافية لدولة الحق بالقانون، والية من اليات الشفافية الإدارية التي تفض ي إلى جو من الثقة بين الإدارة والمواطن.

Abstract

Abstract : The statement of reasons for administrative decisions constitutes one of the most effective mechanisms for enabling both citizens and administrative courts to oversee the legality of administrative actions. It promotes the principle of transparency in administrative activi ty and ensures that administrative authorities comply with the principle of legality in all their dealings and actions. Furthermore, it contributes to reducing bureaucratic practices and curbing the excessive exercise of administrative discretionary power. The requirement to provide reasons for administrative decisions also serves as an additional safeguard for the rule of law and as an instrument of administrative transparency, thereby fostering a climate of trust between public administration and citizens.
