الملخص

تتناول هذه الدراسة موضوع تشغيل المحكوم عليهم من خلال مقاربة شمولية تستند إلى مقتضيات القانون 10.23 المتعلق بتنظيم وتدبير المؤسسات السجنية، وكذا مقتضيات مجموعة القانون الجنائي كما تم تتميمها بالقانون 43.22 المتعلق بالعقوبات البديلة. وقد رصدنا خلال هذه الدراسة أن المشرع لم يعتمد نمطا واحدا لتشغيل المحكوم عليهم، بل عمد إلى تنويع أنماطه تبعا للحالة الجنائية للمحكوم عليه. ورغم تعدد هذه الأنماط وتنوعها، فإنها تلتقي جميعا عند غاية مشتركه تتمثل في تهذيب المحكوم عليه وتقويم انحرافه وإعداده للاندماج في المجتمع كفرد صالح يلبي حاجياته اليومية من كسب مشروع وقانوني، ويساهم في التنمية الاقتصادية للبلاد.

Abstract

This study examines the employment of convicted persons through a comprehensive approach based on the Law No 10.23 relating to the organization and management of prison institutions, as well as the provisions of the Criminal Code as amended by Law No 43.22 on alternative sanctions. The study reveals that the legislator did not adopt a single model for the employment of convicted persons; rather, it established various modes of employment according to the penal status of the convicted person. Despite their diversity, these modes share a common objective: the rehabilitation of convicted persons, the correction of deviant behavior, and their preparation for reintegration into society as law-abiding and productive members capable of meeting their daily needs through lawful work while contributing to the country’s economic development.
