الملخص

تبحث هذه الدراسة في الشروط القانونية والمؤسساتية الكفيلة بتحويل منظومة القيم الصوفية بالمغرب من رصيد روحي ورمزي إلى رافعة فعلية ضمن النموذج التنموي الجديد. وتنطلق من ملاحظة مفادها أن الخطاب الرسمي المغربي أدرج الرأسمال اللامادي ضمن مرتكزات التنمية منذ سنة 2014، في الوقت الذي ظل فيه الحقل الصوفي، بزواياه وطرقه وموارده الوقفية وشبكاته الاجتماعية، خارج دائرة التقنين التنموي الصريح. وتصوغ الدراسة إشكاليتها على النحو الآتي: إلى أي حد يسمح الإطار القانوني والمؤسساتي الراهن بإدماج هذا الرصيد القيمي في السياسات العمومية للتنمية؟ وتدافع عن فرضية مركزية مؤداها أن المنظومة الدستورية توفر الأرضية المعيارية اللازمة لهذا الإدماج، غير أن غياب تشريع خاص بالطرق الصوفية واستمرار اختلالات الحوكمة الداخلية للزوايا يجعلان الإصلاح المزدوج، التشريعي الخارجي والتدبيري الداخلي، شرطًا لازمًا لأي تفعيل. وتعتمد الدراسة منهجًا تحليليًا نقديًا للنصوص الدستورية والتشريعية، تسنده مقاربة وظيفية للقيم ومنهج مقارن انتقائي يستحضر التجارب الإندونيسية والسنغالية والتركية. وتخلص إلى اقتراح معالم إطار قانوني مغربي يقوم على الاعتراف التشريعي بالوظيفة التنموية للمؤسسة الصوفية، وتحديث تدبير أحباسها، وربطها تعاقديًا بالجماعات الترابية، مع صون مبدأ الحياد المؤسساتي للدولة.

Abstract

This study examines the legal and institutional conditions under which the system of Sufi values in Morocco could be converted from a spiritual and symbolic asset into an operational lever within the New Development Model. It starts from the observation that official Moroccan discourse has placed intangible capital at the core of development policy since 2014, while the Sufi field, with its lodges, brotherhoods, endowment resources and social networks, has remained outside any explicit developmental regulation. The central question is the following: to what extent does the current legal and institutional framework allow the integration of this value system into public development policies? The study defends the hypothesis that the constitutional order of 2011 provides a sufficient normative basis for such integration, but that the absence of specific legislation governing Sufi brotherhoods, combined with persistent internal governance deficiencies within the lodges, makes a dual reform, external legislative and internal managerial, a necessary condition for any effective mobilization. The research relies on a critical analysis of constitutional and statutory texts, supported by a functional approach to values and a selective comparison with the Indonesian, Senegalese and Turkish experiences. It concludes by outlining a Moroccan legal framework based on statutory recognition of the developmental function of Sufi institutions, modernization of their endowment management, contractual partnerships with territorial collectivities, and preservation of the principle of institutional neutrality of the State.
