الملخص

تهدف هذه الدراسة إلى التعريف بماهية حقوق الإنسان وبيان خصائصها وأبرز تقسيماتها، وماهية الثورة الرقمية، وأثرها في حياة الأفراد والمجتمعات، وإيضاح الدور الذي ساهمت فيه بتعزيز حقوق الإنسان، وعلى صعيدٍ آخر ناقشت الدراسة أبرز التحديات الناشئة عن الثورة الرقمية والتي أثرت على جُملة من الحقوق الأساسية التي كفلتها المواثيق الدولية والوطنية. ومن أجل تحقيق أهداف هذه الدراسة تم اعتماد المنهج التحليلي، وذلك لملاءمته طبيعة موضوعها، وخلصت هذه الدراسة إلى جُملة من النتائج والتوصيات، ومن أبرزها: أنَ الثورة الرقمية أصبحت من أبرز العوامل التي تؤثر في واقع حقوق الإنسان، ولم يعُد تأثيرها مقتصراً على الجانب التقني فقط، بل يمتد إلى الحقوق والحريات الأساسية للإنسان، كما أوصت الدراسة بضرورة تشجيع التعاون المشترك بين المتخصصين في القانون والتقنيات الحديثة، لغرض إيجاد حلول فعالة للإشكاليات القانونية المُستجدة عن الثورة الرقمية.

Abstract

This study aims to define the concept of human rights, explain their characteristics and main classifications, as well as clarify the concept of the digital revolution and its impact on individuals and societies. It further examines the role of the digital revolution in promoting human rights, while also addressing the major challenges arising from digital transformation and their implications for a range of fundamental rights protected under both international and national legal instruments. To achieve the objectives of the study, the analytical approach was adopted due to its suitability for the nature of the research. The study reached several findings and recommendations, the most significant of which indicate that the digital revolution has become one of the key factors influencing the reality of human rights. Its impact is no longer confined to the technological sphere but extends to the enjoyment and protection of fundamental human rights and freedoms. The study also recommends strengthening interdisciplinary cooperation between legal scholars and technology experts to develop effective solutions to the emerging legal challenges arising from the digital revolution
