الملخص
ملخص: يتناول هذا الموضوع إشكالية الحكامة العقارية للأراض ي السلالية باعتبارها إحدى أهم الروافد العقارية في المغرب، وما يطرح عليها من تحديات مرتبطة بالتدبير والتحديث والتقنين. فالأراض ي السلالية، التي تتميز بطابعها الجماعي والتاريخي، أصبحت اليوم في قلب التحولات التنموية والمؤسساتية، خاصة في ظل النقاش حول تنزيل مشروع الحكم الذاتي. ويهدف هذا الموضوع إلى إبراز كيفية توظيف الحكامة العقارية كآلية لتأهيل هذا الرصيد العقاري وجعله رافعة للتنمية الترابية، مع ضمان التوازن بين حقوق ذوي الحقوق ومتطلبات الاستثمار. كما يناقش الرهانات المرتبطة بملاءمة الإطار القانوني والتنظيمي مع متطلبات الجهوية المتقدمة والحكم الذاتي، إضافة إلى إشكالات التدبير الشفاف والعادل لهذه الأراض ي. ويخلص الموضوع إلى أن نجاح تنزيل الحكم الذاتي يظل رهيناا بإصلاح عميق للحكامة العقارية للأراض ي السلالية، بما يضمن الفعالية، والعدالة المجالية، والاستدامة التنموية.

Abstract
Abstract : This topic addresses the issue of land governance of collective lands as one of Morocco’s key land assets, along with the challenges related to its management, modernization, and legal regulation. Collective lands, characterized by their communal and historical nature, are now at the center of institutional and development transformations, particularly in the context of discussions on implementing autonomy . The aim is to highlight how land governance can serve as a mechanism to enhance this land resource and turn it into a driver of territorial development, while ensuring a balance between the rights of beneficiaries and investment requirements. It also exami nes the challenges of adapting the legal and regulatory framework to advanced regionalization and autonomy, as well as issues of transparency and fairness in land management . The study concludes that the success of autonomy implementation depends largely on a profound reform of land governance of collective lands, ensuring efficiency, spatial justice, and sustainable development .
