الملخص
تتناول هذه الدراسة مفهوم الخصوصية وخصائصها وصورها في إطار دراسة مقارنة بين التشريعات الإماراتية والمصرية والكويتية، وذلك لما يمثله الحق في الخصوصية من ركيزة أساسية من ركائز حقوق الإنسان والحريات الشخصية التي كفلتها الدساتير والمواثيق الدولية. وتنطلق إشكالية البحث من غياب تعريف تشريعي جامع مانع للخصوصية، رغم إحاطتها بحماية دستورية وجنائية واسعة في مختلف النظم القانونية. وتهدف الدراسة إلى بيان المقصود بالخصوصية في اللغة والقانون والفقه، وتحديد خصائص الحق في الخصوصية وأبرز صوره، اعتمادًا على المنهج المقارن المعزَّز بالمنهج الاستقرائي في تتبع التعريفات الفقهية والنصوص القانونية. وقد خلصت الدراسة إلى أن الخصوصية حق أصيل يتسم بالمرونة والقابلية للتغير، ويتمتع بحماية جنائية متطورة، وأن صوره تتعدد لتشمل حرمة المسكن وسرية المراسلات والحياة العائلية والصحية وصورة الإنسان وأسراره المهنية. وتكمن إضافة البحث وجدّته في اقتراح تعريف قانوني منضبط للخصوصية يسد الفراغ التشريعي القائم لدى المشرعَين الإماراتي والمصري والكويتي، فضلًا عن جملة من التوصيات لتحديث القوانين بما يواكب التطور التقني المتسارع وتهديداته المستجدة للخصوصية.

Abstract
This study examines the concept of privacy, its characteristics, and its forms through a comparative analysis of Emirati, Egyptian, and Kuwaiti legislation, given that the right to privacy constitutes a cornerstone of the human rights and personal freedoms guaranteed by constitutions and international conventions. The research problem stems from the absence of a comprehensive legislative definition of privacy, despite the broad constitutional and criminal protection it enjoys across legal systems. The study aims to clarify the meaning of privacy in language, law, and jurisprudence, and to identify the characteristics of the right to privacy and its principal forms, relying on the comparative method supported by the inductive method in tracing jurisprudential definitions and legal texts. The study concludes that privacy is an inherent right characterized by flexibility and adaptability, enjoys advanced criminal protection, and takes multiple forms including the inviolability of the home, confidentiality of correspondence, family and health life, a person's image, and professional secrets. The study's novelty lies in proposing a precise legal definition of privacy that fills the existing legislative gap in Emirati, Egyptian, and Kuwaiti law, together with a set of recommendations to update legislation in line with rapid technological development.
