الحصانات والامتيازات الدبلوماسية للمبعوث الدبلوماسي في فقه المالكية والقانون الدولي: دراسة فقهية قانونية مقارنة
Diplomatic Immunities and Privileges of Diplomatic Envoys in Maliki Jurisprudence and International Law: A Comparative Jurisprudential and Legal Study
الملخص
يعالج هذا البحث جملة من الحصانات والامتيازات الدبلوماسية المقررة للمبعوث الدبلوماسي، بناء على اجتهادات فقهاء المالكية وما منصوص عليه في اتفاقية فيينا للعلاقات الدبلوماسية لعام 1961 والخاصة بالعلاقات الدبلوماسية. وتكمن أهمية هذا البحث، في تجلية الحصانات والامتيازات الممنوحة للمبعوث الدبلوماسي، لتسهيل أدائه لمهامه بكل يسر وسهولة، إضافة إلى بيان مدى عناية الدولة المستقبلة بحرمة شخصه وحمايته من أي اعتداء قد ينال منه أثناء ممارسة مهامه. أما المنهج الذي اعتمده الباحث، وترسم خطاه في هذا البحث، فيتركب من المنهج الوصفي، والاستنباطي، والمقارن. وتتمثل إشكالية هذه الدراسة، في كيفية تحقيق التقارب بين اجتهادات فقهاء المالكية والقانون الدولي في تقرير الحصانات والامتيازات الدبلوماسية المخولة للمبعوث الدبلوماسي؟ وقد توصل الباحث إلى أن الحصانات والامتيازات الدبلوماسية، التي توخاها القانون الدولي للمبعوث الدبلوماسي، قد وجدها متأصلة ثابتة في فقه المالكية، بما يثبت لهم فضل سبق زماني وموضوعي وعملي في بلورة وترسيخ قواعد القانون الدولي الواجبة التطبيق في هذا المجال.

Abstract
This research examines a range of diplomatic immunities and privileges granted to diplomatic envoys, based on the scholarly opinions of Maliki jurists and the provisions of the 1961 Vienna Convention on Diplomatic Relations. The significance of this research lies in clarifying the immunities and privileges granted to diplomatic envoys in order to facilitate the effective and unhindered performance of their duties. It also highlights the concern of the receiving state for the inviolability of the diplomatic envoy’s person and for protecting him from any form of assault that may affect him while carrying out his functions. The study adopts a combination of descriptive, deductive, and comparative approaches. The central research question is: How can convergence be achieved between the views of Maliki jurists and international law regarding the diplomatic immunities and privileges granted to diplomatic envoys? The researcher concludes that the diplomatic immunities and privileges provided for diplomatic envoys under international law are firmly rooted in Maliki jurisprudence. This demonstrates that Maliki jurists had an early, substantive, and practical contribution to the development and establishment of the rules of international law applicable in this field.
