الملخص

تهدف هذه الدراسة إلى تحليل المسؤولية الإدارية عن الخطأ الرقمي في ضوء التحول الرقمي للإدارة العامة، من خلال بيان مفهوم الخطأ الرقمي وصوره، وتحديد الأساس القانوني لقيام المسؤولية الإدارية، مع دراسة أركانها وشروط انعقادها، ومدى كفاية القواعد التقليدية للمسؤولية الإدارية لاستيعاب خصوصية البيئة الرقمية. كما تتناول الدراسة آليات التعويض عن الأضرار الناجمة عن الخطأ الرقمي، ودور القضاء الإداري في حماية حقوق الأفراد وتحقيق التوازن بين متطلبات تحديث الإدارة وضمان الأمن القانوني. وتخلص الدراسة إلى أن نجاح التحول الرقمي للإدارة العامة يقتضي تطوير الإطار التشريعي والتنظيمي المنظم للمسؤولية الإدارية، بما يستجيب للتحديات التي تفرضها البيئة الرقمية، ويضمن حماية فعالة لحقوق المرتفقين، مع ترسيخ مبادئ الحكامة الجيدة، والشفافية، والمساءلة، بما يعزز الثقة في الإدارة الرقمية ويحقق الأمن القانوني في ظل التطور التكنولوجي المتسارع.

Abstract

This study examines administrative liability for digital errors in the context of the digital transformation of public administration. It analyzes the concept and various forms of digital error, identifies the legal foundations of administrative liability, and explores its constituent elements and conditions. The study further evaluates the adequacy of the traditional principles of administrative liability in addressing the unique characteristics of the digital environment. In addition, it discusses the legal mechanisms for compensating damage caused by digital errors and highlights the role of administrative courts in safeguarding individual rights while maintaining an appropriate balance between the requirements of digital transformation and the principles of legal certainty. The study concludes that the successful digital transformation of public administration requires the development of a comprehensive legal and regulatory framework governing administrative liability for digital errors. Such a framework should effectively address the challenges posed by digital technologies, ensure adequate protection of citizens' rights, strengthen the principles of good governance, transparency, and accountability, and ultimately enhance public trust in digital administration while promoting legal certainty in an increasingly technology-driven environment
