الملخص

يعتبر النظام العام الاقتصادي إطارا قانونيا يهدف إلى توجيه وتنظيم النشاط الاقتصادي بما يحقق المصلحة العامة ويضمن استقرار المعاملات وحماية التوازن العقدي بين الأطراف، حث تضطلع قواعد النظام العام الاقتصادي بدور هام في الحد من الآثار التي قد تترتب عن بعض الشروط التعاقدية، وعلى رأسها شروط الإعفاء من المسؤولية، وذلك من خلال وضع قيود على مبدأ سلطان الإرادة ومنع كل اتفاق من شأنه الإخلال بحقوق المتعاقدين أو المساس بمقتضيات العدالة التعاقدية، وفي هذا السياق، تتجلى أهمية النظام العام الاقتصادي في تحقيق التوفيق بين حرية الأفراد في إبرام العقود من جهة، ومتطلبات حماية الطرف الضعيف وضمان الأمن القانوني والاقتصادي واستقرار المعاملات من جهة أخرى.

Abstract

Economic public policy constitutes a legal framework designed to regulate and direct economic activity in a manner that serves the public interest, ensures the stability of commercial transactions, and preserves contractual equilibrium between the parties. In this regard, the rules of economic public policy play a significant role in limiting the effects of certain contractual provisions, particularly exemption from liability clauses, by imposing restrictions on the principle of freedom of contract and invalidating any agreement that undermines the rights of the contracting parties or compromises the requirements of contractual justice. Within this framework, the importance of economic public policy lies in striking a balance between the parties' freedom to conclude contracts, on the one hand, and the need to protect the weaker party, safeguard legal and economic certainty, and ensure the stability of commercial transactions, on the other.
