Abstract

This article examines the issue of legislative inflation in Morocco by defining its concept, causes, and manifestations, and by highlighting its implications for legal certainty, particularly in terms of the clarity of legal rules, the stability of legal positions, legitimate expectations, and the effective application of the law. It also highlights the impact of the proliferation of legal provisions, their frequent amendment, and their overlapping nature on the complexity of the legal system and the reduced predictability of legal rules. In contrast, the article examines the main mechanisms for rationalizing legislation, including legislative impact assessment, improving legal drafting, periodic review of legal provisions, strengthening institutional coordination, and facilitating access to legal information. The article concludes that enhancing legal certainty in Morocco requires the adoption of a legislative policy based on necessity, quality, coherence, and stability, thereby achieving a balance between keeping pace with societal transformations and preserving confidence in the legal rule.
